Terms of Service

1) Overview

Welcome to NextBlitz. These Terms are a binding agreement between NextBlitz ("we", "us") and you. By using the Service, you agree to these Terms.

NextBlitz helps creators generate data‑driven YouTube ideas and content by analyzing signals that you connect and by using AI providers to propose concepts, titles, hooks, thumbnail prompts, and growth suggestions.

2) Eligibility & Accounts

  • You must be at least 13 (or local digital consent age) and able to form a binding contract.
  • You are responsible for your account, credentials, and all activity under it.
  • If using on behalf of a company, you represent you are authorized to bind that company.

3) Changes to the Service

We continuously improve the Service; features may change or be discontinued. We will notify you of material changes.

4) Inputs, Outputs, and Your Responsibilities

  • Your Inputs. You own your prompts, files, and content, including optional YouTube connection data.
  • Your Outputs. AI‑generated results are licensed to you for lawful worldwide use. We do not claim ownership.
  • Review required. Outputs may be inaccurate, non‑original, or unsuitable. You must review and ensure compliance with law, platform rules, and third‑party rights.

5) Acceptable Use (Summary)

You will not use the Service to violate laws, infringe IP/privacy, generate malware/scams/harassment, promote violence or harm, scrape or spam at scale, probe/bypass security, reverse‑engineer, or to train or improve competing models. Platform/vendor rules (YouTube/Google, OpenAI, Gemini, Anthropic) apply.

6) YouTube & Google API Terms

When you connect YouTube, you agree that the Service uses YouTube API Services and Google APIs. By enabling these features you also agree to YouTube’s Terms of Service and Google’s Privacy Policy. We request minimum necessary scopes and provide a clear way to revoke.

7) Third‑Party Providers (AI & Billing)

  • AI Models. We use OpenAI, Google Gemini, and Anthropic Claude under their API terms. We prohibit model extraction and competitive training.
  • Payments via Paddle. Paddle is our Merchant of Record and processes payments, tax, and invoicing.

8) Plans, Trials, Billing & Taxes

  • Subscriptions renew until canceled; trials convert unless canceled before the trial ends.
  • Taxes are calculated and collected by Paddle.

9) Availability & SLA

Unless we sign a separate SLA, the Service is provided without uptime guarantees.

10) IP & Ownership

We own the Service and brand. You retain ownership of Inputs and permitted use of Outputs.

11A) Confidentiality & Non‑Training Commitment

  • No training on your Inputs or Outputs.
  • Vendors configured to disable training where offered; ZDR enabled where available.
  • No human review unless you expressly grant time‑limited support access; access is logged and revoked.

13) Indemnity

You will indemnify NextBlitz from claims arising out of your content, your breach of these Terms, or violations of law/platform rules.

14) Disclaimers

THE SERVICE (INCLUDING ANY AI OUTPUTS) IS PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.

15) Limitation of Liability

OUR AGGREGATE LIABILITY IN ANY 12‑MONTH PERIOD IS LIMITED TO AMOUNTS YOU PAID FOR THE SERVICE IN THAT PERIOD.

16) Termination & Suspension

We may suspend/terminate for violations or risk. You may cancel anytime; see the Refund Policy.

17) Export Controls & Sanctions

You confirm you are not in a restricted jurisdiction and will comply with export/sanctions laws.

18) Governing Law & Disputes

Delaware, USA law governs; courts in Delaware have exclusive jurisdiction unless mandatory consumer law gives you a local forum.

19) Miscellaneous

These Terms are the entire agreement. No assignment without consent except in corporate transactions. Force majeure applies.
